If you fill out a form on our website that requires contact information such as signing up for a newsletter, submitting a request for information or products and services we will collect and process that information to provide you with the communication, products or services.  These types of Personal Information may include your name, email address, company name, job title, your physical address, payment and billing information.

We share Personal Information with our affiliates and partners, as needed to provide our services. We share Personal Information with service providers such as accountants, payment processing companies, and other vendors we use to operate our website and provide our products and services.

    • Social media management platform, Sprout Social, Inc.
    • Other users.
    • Customer service partner Zendesk, Inc.
    • Our payment processing partners, currently: Stripe, Inc. (subject to terms available here); Shopify, Inc. (subject to terms available here); PayPal, Inc. (subject to terms available here); and Apple Pay (subject to terms available here) collect your voluntarily-provided payment card information necessary to process your payment. Please see Stripe’s terms of service and privacy policy for information on its use and storage of your Personal Data.
    • Our online store is currently hosted by Shopify, Inc. (“Shopify”). Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you. When you provide Personal Data in connection with a purchase on or through the Service, such Personal Data is stored through Shopify’s data storage, databases, and the general Shopify application.
    • If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.     • Social networks
      We review our security procedures and implement updates in response to emerging threats or best practices.
      • If you provide your social network account credentials to us or otherwise sign in to the Services through a third-party site or service, you understand some content and/or information in those accounts may be transmitted into your account with us. 

Business Transfers

All of your Personal Data that we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part). Should one of these events occur, we will make reasonable efforts to notify you before your information becomes subject to different privacy and security policies and practices.

Data that is Not Personal Data

We may create aggregated, de-identified or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you. 

Marketing Emails

If you sign-up to receive email marketing communications such as newsletters, we collect your email address as well as other information on an optional basis to help us tailor our communications to you. You can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email. Alternatively, you can opt-out of receiving email marketing communications by contacting us at the contact information provided in the “Contact Information” section below. Please note that you may continue to receive transactional or account-related communications from us.

How Long We Retain Your Information

We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. To exercise the rights described above, you or your Authorized Agent (defined below) must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Data, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not respond to requests that do not meet these criteria. We will only use Personal Data provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 45 days of receipt. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.
Canadian residents: We will respond within 30 days, in accordance with PIPEDA.

We may charge a reasonable fee if your request is not valid under applicable law, repetitive or excessive.  We may also request additional information from you in order to verify your identity before processing your request.

 

Information for California Residents

The California Consumer Privacy Act (CCPA) applies to information collected from California residents. Residents of California have the following rights with regard to their personal information:

  • The Right to Know and Access Information - The categories of personal information we collect is described above in the section entitled “ The  Information We Collect”. California residents may submit a verifiable request regarding the information collected, the types of sources from which personal Information is collected, the purposes for which information is collected, and the specific personal information collected about them.

  • The Right To Portability - California residents may request a copy of their personal information in a format that can be transferred to another person or entity.
  • The Right to Non-Discrimination - We may not discriminate against you if you exercise your privacy rights.

Please note that we may process Personal Data of our customers’ end users or employees in connection with our provision of certain services to our customers. California Resident Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at info@lusbrands.ca.

Nevada Resident Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at info@lusbrands.ca with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account.
We do not currently sell covered information as defined under Nevada law, but you may submit a request to opt-out of future sales.

Canadian Resident Rights

Access to Information
In accordance with PIPEDA, we obtain your consent before or at the time of collection, and you may withdraw your consent at any time. We use implied consent where appropriate, such as when you provide information to complete a transaction.

Subject to applicable law, you have the right to access, update and correct inaccuracies in your Personal Data in our custody or control. You may request access, updating and corrections of inaccuracies in your Personal Data in our custody or control by emailing or writing to us at the contact information set out below. We may request certain Personal Data for the purpose of verifying the identity of the individual seeking access to his or her Personal Data records.

Transfer and Processing of Personal Data Outside of Canada

European Union Data Subject Rights

EU Residents

If you are a resident of the European Union (“EU”), United Kingdom, Lichtenstein, Norway or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data, as outlined below. 

For this section, we use the terms “Personal Data” and “processing” as they are defined in the GDPR, but “Personal Data” generally means information that can be used to individually identify a person, and “processing” generally covers actions that can be performed in connection with data such as collection, use, storage and disclosure. LUS (Love Ur Self) Brands will be the controller of your Personal Data processed in connection with the Services.

If there are any conflicts between this section and any other provision of this Privacy Policy, the policy or portion that is more protective of Personal Data shall control to the extent of such conflict. We will only process your Personal Data if we have a lawful basis for doing so. Lawful bases for processing include consent, contractual necessity and our “legitimate interests” or the legitimate interest of others, as further described below.

  • Contractual Necessity:  We process the following categories of Personal Data as a matter of “contractual necessity”, meaning that we need to process the data to perform under our Terms of Use with you, which enables us to provide you with the Services. When we process data due to contractual necessity, failure to provide such Personal Data will result in your inability to use some or all portions of the Services that require such data. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision.  In some cases, we may also need to you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request. 

  • Access:  You can request more information about the Personal Data we hold about you and request a copy of such Personal Data.
  • Rectification:  If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. You can also correct some of this information directly by logging on to your account.
  • Erasure:  You can request that we erase some or all of your Personal Data from our systems. 
  • Withdrawal of Consent:  If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.
  • Portability:  You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.
  • Objection:  You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes, such as for direct marketing purposes.
  • Restriction of Processing:  You can ask us to restrict further processing of your Personal Data.
  • Right to File Complaint:  You have the right to lodge a complaint about LUS(Love Ur Self) Brands’ practices with respect to your Personal Data with the supervisory authority of your country or EU Member State. International Data Transfers

By using the Services, you acknowledge that any Personal Data about you, regardless of whether provided by you or obtained from a third party, is being provided to LUS (Love Ur Self) Brands in Canada, and you authorize LUS (Love Ur Self) Brands to transfer, store and process your information to and in Canada, and possibly other countries.  You hereby consent to the transfer of your data to Canada pursuant to: (i) a data processing agreement incorporating standard data protection clauses promulgated by the European Commission, a copy of which can be obtained at https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=celex%3A32010D0087, (ii) binding corporate rules for data protection that align with the GDPR’s requirements, or (iii) adherence to an industry- or technology-specific approved code of conduct blessed by the European Commission.

Personal Information may be transferred from users residing in the European Union to our servers, partners, or vendors located in the United States and other non-EU countries where there may not be an adequacy opinion issued with respect to that country. We have taken appropriate safeguards to ensure that Personal Information remains protected wherever it is transferred.  When we transfer Personal Information of individuals in the European Economic Area (“EEA”), Switzerland or the United Kingdom (“UK”) to the US, we make use of the Standard Contractual Clauses and the UK Addendum as well as additional safeguards where appropriate. We are also certified to the EU-US and Swiss-US Privacy Shield Principles to help safeguard the transfer of information we collect from the EEA, Switzerland and the UK.

Security

We take all reasonable steps to protect the information we receive from you from accidental or unlawful destruction, loss, alteration, and unauthorized disclosure or access. We have put in place appropriate physical, technical, and administrative measures to safeguard and secure your information, but no security measures are perfect; the risk of a data breach is possible.
